THE ACTION WAS BASED ON HIS MISDEMEANOR CHARGE FOR FAILURE TO FILE AN INCOME TAX RETURN AND FOR DISCIPLINARY ACTION TAKEN BY ANOTHER STATE MEDICAL BOARD. ON FEBRUARY 5, 2010, THE BOARD ISSUED AN ORDER GRANTING TERMINATION OF HAROLD AUSTIN TATE, M.D.'S 2008 FIVE-YEAR AGREED ORDER THAT REVOKED HIS LICENSE, BUT STAYED THE REVOCATION, AND IMPOSED CERTAIN TERMS AND CONDITIONS. THE 2008 ORDER ISSUED AS THE RESULT OF BOTH A CALIFORNIA MISDEMEANOR CHARGE FOR WHICH DR. TATE RECEIVED DEFERRED ADJUDICATION, AND WAS LATER DISMISSED ON OCTOBER 9, 2009, AND A RELATED CALIFORNIA MEDICAL BOARD DISCIPLINARY ACTION. THE 2008 ORDER REQUIRED THAT DR. TATE SATISFY THE REQUIREMENTS IMPOSED BY BOTH THE CALIFORNIA CRIMINAL PROBATION AND THE CALIFORNIA MEDICAL BOARD DISCIPLINARY ORDER, AFTER WHICH DR. TATE COULD PETITION FOR TERMINATION OF THE 2008 ORDER. DR. TATE SHOWED THE BOARD THAT HE HAD COMPLETED THE CALIFORNIA PROBATION, AND THAT THE OFFENSE WAS REDUCED FROM A FELONY TO A MISDEMEANOR THEN DISMISSED, AND HAD COMPLETED COMPLIANCE WITH THE CALIFORNIA MEDICAL BOARD DISCIPLINARY ORDER.
